Ask Mabs : Car rental disputes

Hi Mabs

In February, my sister rented a car from a leading rental company for a trip to a relative’s funeral in Limpopo. She felt uneasy driving her car due to the village being known for African Magic. On our return journey, we noticed minor scratches under the front bumper. Upon returning the car, the rental company staff said they would deduct the repair costs from her credit card hold. However, it’s been three months, and they keep delaying releasing the remaining funds. I’ve advised a friend in a similar situation with dents to keep the car longer and get it repaired at a panel beater. Was I wrong?

Mabs answers:

I am sorry to hear about your sister’s experience with the rental company. It is frustrating not to receive refunds on time, and it seems like the company didn’t provide enough transparency regarding the repair costs. They should have informed your sister about the cost of fixing the bumper and released the remaining funds promptly. It’s unfair for her to have to chase after them three months later.

She can approach the Southern African Vehicle Rental and Leasing Association (SAVRALA, www.savrala.co.za) and lay a complaint against the rental company.

However, I strongly disagree with your advice to your friend. it is dishonest to conceal an accident from a rental company and could have legal consequences. It’s important to handle such situations transparently and responsibly, especially considering that the car is likely insured and the repairs could be covered under warranty.

If your friend takes your advice, he might be in trouble with the law. On this one, you were absolutely wrong.
